1. Acceptance of Terms

These Terms of Service govern your access to and use of Melissa Answers. By creating an account, starting a trial, purchasing a subscription, or using the service, you agree to these Terms.

2. Description of Service

Melissa Answers provides AI-powered call answering, lead capture, customer intake, appointment scheduling, notifications, transcripts, summaries, and related business tools. Features may change, be improved, or be discontinued over time.

3. Account Responsibilities

You are responsible for maintaining accurate account and business information, protecting your login credentials, and all activity occurring through your account. You must promptly notify us of suspected unauthorized access.

4. Call Recording and Consent

The service may record, transcribe, summarize, and analyze calls. You are responsible for providing legally required disclosures and obtaining any necessary consent from callers. You are also responsible for complying with federal, state, local, and international call-recording and privacy laws applicable to your business.

5. Artificial Intelligence

Melissa Answers uses automated systems and artificial intelligence. AI-generated responses, summaries, classifications, appointment details, and lead information may occasionally be incomplete, inaccurate, or misunderstood. You are responsible for reviewing important information and making final business, safety, pricing, legal, and service decisions.

6. Emergency and Safety Limitations

Melissa Answers is not an emergency response service. It must not be relied upon to contact police, fire departments, emergency medical services, utility emergency lines, or other emergency responders. Callers facing immediate danger should contact the appropriate emergency service directly.

7. Subscriptions and Billing

Paid subscriptions are billed in advance according to the plan selected during checkout. Unless otherwise stated, subscriptions automatically renew until canceled. You authorize us and our payment provider to charge the payment method associated with your account.

8. Free Trials

Trial eligibility and duration may vary. Unless canceled before the trial ends, your account may automatically convert to a paid subscription at the price shown during checkout. Trial access may be limited to one trial per person, business, payment method, or account.

9. Cancellation and Refunds

You may cancel your subscription through the available account or billing controls. Cancellation prevents future renewals but does not automatically refund previously paid amounts. Except where required by law or expressly stated otherwise, fees are non-refundable.

10. Acceptable Use

You may not use Melissa Answers to:

• Violate any law or regulation
• Harass, threaten, deceive, or impersonate another person
• Send spam or conduct unlawful telemarketing
• Collect information without required notice or consent
• Interfere with or damage the service
• Attempt unauthorized access to accounts or systems
• Reverse engineer or misuse the service
• Use the service for fraudulent or harmful activity

11. Third-Party Services

Melissa Answers relies on third-party services for telephony, artificial intelligence, cloud hosting, payments, email, databases, authentication, and calendar integrations. We are not responsible for outages, changes, errors, or acts of third-party providers outside our reasonable control.

12. Availability and Modifications

We do not guarantee uninterrupted or error-free operation. We may perform maintenance, modify features, impose usage limits, or suspend portions of the service when reasonably necessary.

13. Intellectual Property

Melissa Answers and its software, branding, interfaces, designs, documentation, and related materials are owned by us or our licensors. These Terms do not transfer ownership of any intellectual property rights.

14. Customer Data

You retain your rights to information you submit to the service. You grant us permission to host, process, transmit, and use that information as necessary to provide, secure, support, and improve Melissa Answers.

15. Disclaimer of Warranties

To the fullest extent permitted by law, Melissa Answers is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, and non-infringement.

16. Limitation of Liability

To the fullest extent permitted by law, Melissa Answers and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost revenue, lost profits, lost leads, missed appointments, business interruption, or loss of data.

Our total liability arising from or related to the service will not exceed the amount you paid to Melissa Answers during the three months immediately preceding the event giving rise to the claim.

17. Indemnification

You agree to indemnify and hold harmless Melissa Answers and its owners, employees, contractors, and service providers from claims, damages, losses, and expenses arising from your use of the service, your business activities, your customer interactions, your violation of these Terms, or your violation of applicable law.

18. Termination

We may suspend or terminate access when an account violates these Terms, creates risk, fails to pay applicable fees, or uses the service unlawfully or abusively. You may stop using the service and cancel your subscription at any time.

19. Changes to These Terms

We may update these Terms periodically. Updated Terms will be posted on this page with a revised effective date. Continued use of the service after an update constitutes acceptance of the revised Terms.
